You already get Individual Unemployability pay. A letter shows up. Someone says file 21-8940 again. Someone else says fill the employment questionnaire. Those are different papers. VA Form 21-4140 is the IU employment questionnaire. VA Form 21-8940 is how you apply.
What it actually is
VA Form 21-4140 (revision August 2024) is Employment Questionnaire. VA.gov’s page (updated March 12, 2026) is a stub: the form name, one sentence (“use this if we asked you to verify your employment status because you currently receive Individual Unemployability”), a PDF link, and an online tool. That is the whole page. It never prints the boxes.
The August 2024 PDF is the list. The top line is blunt: you are receiving compensation at the 100 percent rate based on being unable to secure or follow a substantially gainful occupation as a result of your service-connected disabilities. This paper is not the IU application. It is the questionnaire VA uses when it asks you to verify employment while you already receive IU.
- 21-4140 — recertify / verify. Employment Questionnaire. Fill it when VA asked you to verify employment status for IU you already get. Privacy Act notice on the PDF: your obligation to respond is required to obtain or retain benefits. Signature block: continued entitlement to VA unemployability compensation benefits will be based on information you furnish on this form (or that you hereafter may be required to furnish).
- 21-8940 — apply. Veteran’s Application for Increased Compensation Based on Unemployability (revision July 2024). The PDF’s important line: this is a claim for compensation benefits based on unemployability. You are claiming total disability because a service-connected disability prevents you from securing or following any substantially gainful occupation. Official IU how-to also pairs it with 21-4192 for the most recent employer. That apply path is not today’s 4140 job.
- Two form numbers. 4140 does not become 8940 when you “reapply.” Different OMB numbers. Different jobs.
Section I is you. Name, SSN, VA file number, date of birth, service number if applicable, email, phones, mailing address.
Item 10 is the fork. Were you employed by VA, others, or self-employed at any time during the past 12 months? Yes → complete Section II only. No → complete Section III only. Do not invent a third path.
Section II is employment certification for the past 12 months. For each job (write “self” if self-employed): name and address of employer, type of work, hours per week, dates of employment or self-employment (from/to), time lost from illness, highest gross earnings per month. Then sign Item 12A in ink and date Item 12B. The certification says the statements are true and complete, and that continued entitlement to VA unemployability compensation benefits will be based on what you furnished.
Section III is unemployment certification if you did not work during the past twelve months. You certify you have not been employed by VA, others, or self-employed during that period, that the items are true and correct, and that you believe your service-connected disability(ies) has not improved and continues to prevent you from securing or following gainful employment. Sign Item 13A in ink. Date Item 13B.
Where paper goes: Department of Veterans Affairs, Evidence Intake Center, P.O. Box 4444, Janesville, WI 53547-4444 — same mailbox printed on the August 2024 PDF and on the verify Individual Unemployability status page (updated March 12, 2026). That verify page also prints why VA asks (SSA wage match above the poverty line, or other evidence you are gainfully employed) and the clock: verify within 65 days of the notice you received in the mail. Online when the tool is up — screenshot the confirmation. A saved draft is not on file.
OMB on 21-4140: 2900-0079, expires 08/31/2027. Respondent burden: 5 minutes. Supersedes VA Form 21-4140, July 2021.
This form is not the IU eligibility test. It is not 21-8940. It is not 21-4192 for your employer. It is not a new disability claim by itself. Eligibility rules stay on the official Individual Unemployability page — this post does not rewrite them.
Do this today
- Read the notice. If VA mailed you an employment verification ask for IU you already receive, the questionnaire is 21-4140. If you are trying to *start* IU, that is 21-8940 (and usually 21-4192 for the employer) — different paper.
- Open VA Form 21-4140. Revision August 2024. Print or use the online tool linked from that page.
- Finish Section I. Then answer Item 10 honestly: employed (VA, others, or self) at any time in the past 12 months — Yes or No.
- Take the fork. Yes → Section II only. List every job for the past 12 months. No → Section III only. Do not leave both blank. Do not fill both.
- Sign in ink. Section II uses 12A/12B. Section III uses 13A/13B. Date it.
- File online when you can. Use the tool on the form page. Screenshot the confirmation.
- If you must mail: Evidence Intake Center, P.O. Box 4444, Janesville, WI 53547-4444. Paper is the date VA receives it, not the postmark. Certified mail with return receipt is how you prove receipt. Keep a copy. Official verify clock: within 65 days of the notice.

What people get wrong
“VA asked me to verify — I’ll just file 21-8940 again.” 8940 is the apply form. 4140 is the employment questionnaire for IU you already get. Wrong paper wastes the 65-day window on the notice.
“4140 and 8940 are the same IU form.” Two numbers. August 2024 questionnaire vs July 2024 application. Different sections. Different job.
“I can skip Item 10 and write a letter.” Item 10 is the fork. Yes → Section II only. No → Section III only. The PDF does not give a third path.
“I only worked a little, so Section III is fine.” Any employment by VA, others, or self in the past 12 months means Section II. Marginal work still goes in the boxes when Item 10 is Yes.
“My employer already sent 21-4192, so I don’t need 4140.” 21-4192 is the employer form on the *apply* path with 8940. It is not the veteran’s employment questionnaire for an IU verification ask.
“I’ll wait until the notice expires and reapply.” The verify page prints 65 days from the notice. The 4140 PDF says continued entitlement is based on what you furnish, and the Privacy Act notice says responding is required to obtain or retain benefits. Do not invent a free pass.
“This questionnaire changes my disability rating.” Official IU page: IU can change the monthly compensation amount; the disability rating stays the same. 4140 is employment verification, not a new rating decision by itself.
“Any regional office mailbox is fine.” The PDF and the verify page both print Evidence Intake Center, PO Box 4444, Janesville, WI 53547-4444. Online when you can. That mailbox when you must paper.
Two papers. 21-8940 is how you apply for IU. 21-4140 is the employment questionnaire when VA asks you to verify. Item 10. Section II or Section III. Not the eligibility page. Not a new claim by itself.
